Human Resources Management

  • Serve as principal in-house employment law counsel and/or Vice President of Human Resources to emerging and growing companies or serve as extension to such departments.

  • Prepare employee handbooks and policies governing such areas as sexual harassment, background checks, pre-employment testing, leaves of absence, and protection of trade secrets.

  • Develop and present training programs for employers and human resources personnel in critical employment law areas, such as sexual harassment and discrimination, employee compensation, and leaves of absence.


Harassment and Discrimination

  • Defend employers against claims of discrimination, harassment and retaliation brought under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, and similar laws.

  • Investigate and defend against complaints filed with the Equal Employer Opportunity Commission (EEOC), Department of Fair Employment and Housing (DFEH) and/or internal company complaints.


Wage and Hour Compliance

  • Advise and represent employers in federal and state wage and hour laws.

  • Conduct compliance audits regarding wage and hour issues, such as overtime, meal breaks, rest breaks and recordkeeping.


Leaves of Absence and Disability

  • Advise on the Family and Medical Leave Act (FMLA), the Americans with Disability Act and its state law counterparts, state workers’ compensation laws, and pregnancy leave.

  • Evaluate and process leave of absence requests and the interactive process.


Unfair Competition, Trade Secrets and Confidential Information

  • Prepare non-compete, non-solicitation, non-disclosure, and confidentiality agreements.

  • Develop strategies that prevent misappropriation of trade secrets and proprietary information.


Mergers, Acquisitions and Downsizing

  • Advise employers in corporate transactions, including conducting due diligence and drafting employment, consulting and severance agreements, and transitional services agreements, and other pre and post-closing integration activities.

  • Manage reductions in force, WARN notices and settlement of disputes.


Labor Relations and Collective Bargaining

  • Advise employers on daily compliance with collective bargaining agreements.

  • Represent employers in binding arbitrations pursuant to grievance arbitration procedures.
